Napster wins temporary reprieve

The fate of online MP3 music swapping service Napster seemed sealed at the end of July when a US Federal judge ordered it to stop aiding the exchange of copyrighted material.

The fate of online MP3 music swapping service Napster seemed sealed at the end of July when a US Federal judge ordered it to stop aiding the exchange of copyrighted material.

Judge Marilyn Hall Patel gave Napster until midnight on 28 July to comply with the injunction brought by the Recording Industry Association of America, but also requested that a $5m bond be posted to cover loss of earnings should Napster subsequently prevail.

Nine hours before the 28 July deadline, however, Napster was granted a reprieve. The 9th US Circuit Court of Appeals overturned the judge's injunction, saying that Napster had raised "substantial questions" on its merits and form.

Napster is now allowed to continue operating until its trial, which starts on August 18, is over. The website has seen a massive increase in usage since the rulings, making it one of the internet's most popular destinations.
